Membership Terms

The Member agrees that:

(i) He/she has read the terms and conditions herein, Member's Agreement Acknoledgement List and The Centre's Rules and Regulations and accepts them as a legal and binding contract;

(ii) He/she is of legal age and capacity and has voluntarily entered into this Agreement or has obtained consent of the guardian to enter into this Agreement.

This minimum age restrictions does not apply to selected 'Member-Child' or FOXX Cubs Series Programmes.

The Member agrees that this Membership is not transferable.

Suspension of Membership is not allowed within the contractual period unless supported with valid reasons to be approved by The Centre.

In an event a Member does required a Membership suspension with a valid reason, he/she can submit a request through the Operation Department via hello@fittboxx.com (E-mail) accompanied with supporting documentation for The Centre Management's review; where suspension fees may apply. Suspendion will take effect after ten (10) wortking days from the date when The Centre approves the suspension request.

membership period will be extended by the same number of months suspended. For monthly Dues Membership, Members will continue to be liable for the full payment of the membership which is subjected to auto-renewal on a month-to-month basis.

Backdated suspension requestes will not be entertained.

By filling up the sign-up page on FIITBOXX Mobile Application with your personal data ("your personal Information"), you consent to our collection of your Personal Information and further acknoledge and agree that The Centre; Its officers, employees and agents may use your Personal Information to process your application and registration; to conduct market research and analysis; for direct marketing through voice call, text messages, email, direct mail and facsimile messages,inter alia; to ascertain if you are eligible for discounts, privileges or benefits or other related purposes.

We also intend to use your phone number, postal address, facimile and email address in direct marketing activities such as promotion of our fitness, transmission of our newsletters and e-newsletters, contract renewal and upgrades (including but not limited to renewal of your membership, Personal Coaching packages and others), market updates, subscription updates, inter alia and other services or updates.

You hereby provide your clear and unambiguous consent to us contacting you via voice calls; text messages; email; direct mail or facsimile messages for the purposes of direct marketing of our products and/or services, as well as the products and/or servies of our marketing parthers from time to time.

Disclosure of your Personal Information: The Centre is part of a group of companies and to carry out functions described above, The Centre may, from time to time, disclose your Personal Information to our holding company, subsidiary company, associared companies, and companies which are subsidiaries of our holding company. The Centre shall take reasonable precautions to preserve the integrity and prevent any corruption or loss, damage or destruction of the Member's personal data and information

A. The Member will be in default if he/she breaches any of these Terms and Conditions herein/Centre's Rules and Regulations, as may be amended and applicable from time to time; or

B. If the Member fails to pay The Centre any Monthly Dues within fifteen (15) dats after the scheduled Autopay date. If the Member is in default, his/her Membership privileges may be suspended and the remainding balamnce of the Membership Dues under this Agreement may become immediately due and payable at The Centre's option

Acceptance of any payment aftert default will not release the Member from any obligation under this Agreement to continue payment.

The Centre reserves the right to charge a late payment penalty equivalent to an amount of S$15/- for each delated payment.

The Centre may take appropriate actions to recover any outstanding payments and the Member shall indemnify The Centre for any costs incurred by or associated with such legal actions on a solicitor and client basis.

A. The Member fully understands that he/she is engaging in physical exercise, training and instructions by The Centre's Personnel, which may causer injury or a risk of abnormal body changesto him/her.

He/she hereby agrees that he/she is a voluntary participant in physical exercise, the use of The Centre's facilities,training and instructions by The Centre's personnel and that he/she is assuming all risks of injury or of adnormal body changes to him/her on account of these activities.

It is furture agreed that The Centre will not perform and is not required to perform any evaluation of the Member's physical condition, which might result in the identification of risk factors contradicting and/or prohibiting physical exercise prior to his/her starting or continuing an exercise activity.

B. The Member hereby warrants represents and agrees that he/she has no physical disability impairment or ailment preventing him/her from engaging in any exercise activity, or that will be detrimental to his/her health, safety, comfort, or physical condition, or that of others.

The member further undertakes that he/she will consult his/her physician before undertaking an exercise programmes.

C. The Centre shall not be liable or respensible for any injury or adnormal body changes caused as a result of the use of The Centre's facilities, training and instructions by The Centre's personnel.

A. Save for willful misconduct or gtoss negligence by The Centre, the Member hereby waives any and all claims or rights or whatsoever nature he/she might otherwise have against The Centre.

B. The Member has carefully read this clause and fully understands this as a release of any and all future claims of whatsoever nature against The Centre including but not limited to injury or risk of injury or a rish of adnormal body changes resulting from activies while utillzing the Centre's facilities and/or classes in The Centre, save for wilful misconduct or gross negligence by The Centre.

The Member will be Bound by The Centre's Rules and Regulations as may be amended and applicable from time to time, a copy of which is available under Terms and Conditions in FIITBOXX mobile application.

A. In the event of any private-organized fitness training, The Centre shall reserve the right to deny access and/or usage of selected facilities and is not liable for any conpensation for loss of use resulting from such remporary closures.

B. The Centre reserves the right to open new Centres, relocate Centres, close any Centres and/or close any of The Centre'a facilities or any part thereof by giving not less than seven (7) days notice to the Members at the affected Centre and the Member agrees to use alternative Centre and should not be entitled to terminate the Membership or claim a refund (Pro-Rated or otherwise).

In particular and without prejudice to the generality of the foregoing, in the event of any redevelopment/ relocation/ acquistion of any Centers buy the Landlord of The Centre or the relevant authorities, the Member agrees to use the nearest or any alternative Centre and should not be entitled to terminate the Membership or claim a refund (pro-rated or otherwise) by reason of such redevelopment/ relocation/ acquistion.

This Agreement and the Member's Agreement Acknowledgement List ("the Agreements") constitute the entire amnd exclusive agreement between the parties. Any promises, representations, understanding and/or agreements pertaining directly or indirectly to the Agreements, which are not display herein do not bind The Centre in any way and/or are hereby waived.

I furture confirm that there are no other terms discussed or agreed with me, verbally or otherwise, and/or any representation made by me by any of FIITBOXX/FOXX Centre's agents,employees and/or representatives other than those contained in the Agreement.

If any particular provision of thr Agreements are invalid, the same shall not affect the other provisions hereof. FIITBOXX and/or FOXX may assign the benefit of the Agreements to any person, firm or company at any time without prior notice to you. The Agreements are governed by the laws of Singapore.
